Mediation is a non-adversarial alternative to litigation with attorneys. The purpose of mediation is to help the parties reach their own agreements that resolve the dispute.
In mediation, the mediator:
- Is a neutral third party that doesn’t represent either party but represents the process of helping the parties work together to resolve their dispute.
- Guides the process.
- Helps the parties discuss the issues in dispute together or separately.
- Helps the parties explore options that will lead to solutions.
- Drafts the Memorandum of Understanding that describes the agreements reached by the parties.
