When is Divorce Mediation Not Recommended?

Divorce mediation is effective in most disputes. Divorce mediation is not recommended in the following situations:
- When the parties in dispute are not willing to negotiate in good faith including not being willing to make any concessions needed to reach an agreement.
- When the parties have a major power imbalance including where domestic violence is involved. Some mediators have training and experience in mediating disputes involving domestic violence including having additional safety precautions in place.
- When a party to the dispute has no trust in the disclosures made by the other party. This is especially true when it comes to financial disclosures.
